Proving a Financial Loss: Connect the Number to the Evidence
A damages demand needs more than a total. Connect each claimed loss to the alleged wrong, supporting records and an available legal remedy.
Create a transparent calculation
Break the amount into categories such as unpaid charges, repair expenses or other claimed losses. Show dates, quantities, credits and the source of each figure. Distinguish actual payments from estimates and avoid counting the same loss twice.
Examine causation and limits
Not every expense following a dispute is legally recoverable. Counsel must assess causation, foreseeability, contractual limits, mitigation and the governing claim. Lost-profit or future-loss theories may require additional records or qualified analysis.
Consider the practical recovery
A judgment and collection are separate matters. Litigation cost, insurance, available assets and enforcement procedures may affect the value of pursuing a claim. An honest assessment compares the supported remedy with the expense and uncertainty of obtaining it.
At a glance
| Calculation field | Example |
|---|---|
| Source | Invoice, ledger, estimate or expert analysis |
| Adjustment | Credit, avoided cost or overlapping amount |
A business claims both the full replacement price of an item and the full repair bill for the same damage. The figures may overlap. Explain the actual sequence and have counsel assess the proper measure rather than simply adding every expense.
What to gather before a consultation
- A line-item loss summary
- Underlying invoices and payment proof
- Records of reasonable mitigation efforts
One more question
Does winning automatically mean immediate payment?
No. Collection may require additional steps, and collectability is a separate practical issue.
