The Marital Home in Divorce: Compare the Practical Options

Keeping, selling or temporarily sharing responsibility for a home each creates a different set of risks. Evaluate financing and implementation before negotiating a final choice.

Identify the legal and financial starting point

Collect the deed, mortgage statements, home-equity loan information, insurance and tax records. Ownership and liability on a loan are separate issues. An agreement between spouses does not automatically release a borrower from the lender’s contract.

Test the affordability of keeping it

Consider the mortgage, utilities, repairs, taxes, insurance and any buyout payment. Determine whether refinancing is available before making it the only exit plan. A budget should account for future maintenance rather than just the current monthly payment.

Write an exit plan

If the property will be sold, specify responsibilities for preparation, listing, offers, carrying costs and distribution of proceeds. If one person will refinance, discuss a deadline and a fallback if approval fails. Review possible tax and title consequences with the appropriate professionals before completing transfers.
