Preserving Digital Evidence for a Criminal Defense

Phones and accounts can contain important evidence, including material that may disappear automatically. Preservation should protect the original record without changing or unlawfully accessing it.

Identify where information lives

List devices, accounts, cameras and service providers that may hold relevant material. Note dates, times and whether automatic deletion occurs. Tell counsel promptly about short retention periods; simply knowing a recording once existed does not ensure it can be recovered.

Keep context and originals

A screenshot may omit dates, participants or attachments. Preserve complete threads and original files when lawfully available, and avoid editing them. Do not log into someone else’s account or bypass restrictions to obtain potential evidence.

Discuss collection with counsel

How material is obtained, stored and authenticated may affect its usefulness. Counsel can assess preservation requests, discovery and other lawful procedures. Keep a record of what was saved and when, and avoid circulating sensitive material casually.
