Expunction Questions: Start with the Actual Case Record
Record relief depends on the offense, disposition, dates and statutory requirements. A background-check summary is not always enough to determine eligibility.
Collect accurate dispositions
Obtain case numbers and the final result of each relevant charge. Dismissal, acquittal and conviction are different events. An old pending entry or incomplete private database report may not accurately describe the court record.
Review the complete history
Eligibility can depend on the type of offense, age, waiting periods, prior matters and changes in the law. Expunction statutes contain detailed conditions and exceptions. Avoid relying on a broad statement that all dismissals or all older convictions receive the same treatment.
Understand the limits
The effect of an expunction and what must be disclosed in a particular setting require careful review. A court order may not instantly correct every private database. Keep copies of the disposition and any expunction order, and obtain advice about correcting inaccurate reporting.
