A North Carolina DWI Can Create Two Separate Tracks
A DWI matter can involve the criminal court and driving privileges on different timelines. Organize the papers by decision maker and deadline rather than treating them as one file.
Identify the court case
The criminal case addresses the alleged offense and its disposition. The stop, observations, testing, statements and other evidence may be relevant to the defense. Counsel needs the charging documents and an accurate account of what occurred, including any testing request or refusal.
Identify the license issue
Civil revocation, administrative action or later conviction-related consequences may affect driving separately. Eligibility for relief and the timing of a request depend on specific facts and statutes. Never assume that a pending court case means the license remains valid or that a privilege permits unrestricted driving.
Build a coordinated calendar
Keep every DMV and court notice with the date received. Discuss work, school and transportation needs, but do not drive based on a hoped-for result. A defense plan should account for both tracks and any requirements attached to an order or privilege.
At a glance
| Track | Primary question |
|---|---|
| Criminal court | What allegation and evidence must be addressed? |
| Driving privileges | What notice, restriction and deadline currently apply? |
A driver’s criminal case is continued, but a license deadline remains unchanged. The new court date does not automatically extend the administrative deadline. Calendar the two separately and have counsel review both.
What to gather before a consultation
- Citation and court dates
- All DMV and revocation notices
- Testing and driving-history information
One more question
Does a lawyer’s involvement restore my license?
No. Driving authority depends on the valid license status and any court or DMV action, not merely hiring counsel.
