A DWI defense depends on the full sequence of the encounter. A test result is important, but it is not the only part of the record that may need examination.
Reconstruct the encounter
Identify why the vehicle was stopped, what the officer observed and how the investigation developed. Record road conditions, timing, location and available witnesses. Counsel will assess the legal significance; a disagreement with an observation alone does not establish a defense.
Identify the records
Potentially relevant material can include reports, video, testing documents and witness accounts. Availability and methods for obtaining records vary. Tell counsel promptly about a recording that may be overwritten or a witness whose contact information may be lost.

A procedural concern, an inconsistent statement or an equipment question must be evaluated in context. The remedy for a legal issue depends on the applicable law and the record. Promises that one detail always defeats a DWI charge should be treated skeptically.
