Police Contact During an Investigation: Protect the Record
An unexpected request to discuss an incident deserves a deliberate response. Stay calm, avoid false information and seek legal advice about the particular situation.
Understand the request
Determine who is contacting you and in what capacity. An informal request, a subpoena, a warrant and a court order are different. Verify official identity through a reliable channel if there is uncertainty, and do not ignore legal documents that require a response.
Avoid trying to solve the case by guessing
Do not invent answers, speculate about another person or assume an offhand explanation will remain informal. A person may not know the scope of an investigation. An attorney can help assess whether, when and how to communicate lawfully.
Preserve relevant material
Keep messages, notices and documents related to the contact. Do not delete records, hide evidence or ask another person to change an account. Lawful preservation supports a later review regardless of whether the contact leads to a charge.
