Release Conditions and No-Contact Orders: Read Every Term
Release from custody can come with restrictions that remain enforceable while the case is pending. The safest starting point is the exact wording of every current order.
Collect the complete conditions
Review bond paperwork, protective orders and any later modifications. Conditions may address contact, location, travel, substances, weapons or other matters. If a term is unclear, ask counsel to explain it rather than choosing the most convenient interpretation.
Do not rely on private permission
Another person’s invitation or willingness to communicate may not change a court restriction. Indirect communication through friends, social media or shared accounts can also create issues depending on the wording. Discuss necessary parenting or property exchanges through lawful channels.
Seek a formal change when needed
Work, housing or family needs may justify asking whether a modification is available. A request is not approval. Keep complying with the existing conditions unless and until an authorized change actually occurs, and retain the updated order.
At a glance
| Situation | Issue to clarify |
|---|---|
| Invitation to meet | Does an order still prohibit contact? |
| Work travel | Is permission required before leaving? |
A relative offers to pass along a message to someone protected by a no-contact condition. Depending on the terms, indirect contact may still be prohibited. Ask counsel about an authorized method instead of treating a third party as a workaround.
What to gather before a consultation
- Release paperwork
- Protective and custody orders
- All written modifications
One more question
Can a text from the other person cancel the restriction?
No. A private message is not a court modification.
