Property Division: Build an Inventory Before Arguing About Value

Before discussing who should receive property, identify what exists, how it is owned and what debt is attached. A consistent inventory makes negotiation more productive.

List assets and obligations

Include real estate, vehicles, accounts, retirement interests, business interests and significant personal property. Record account endings rather than full account numbers in a working summary shared casually. Keep the underlying statements securely. Debts need the creditor, balance, obligor and purpose.

Distinguish classification from valuation

Whether an item is marital, separate or divisible property is a legal question. Its value is a different question. Acquisition dates, gifts, inheritances, tracing records and changes around separation can matter. Do not assume that title alone resolves classification or that an online estimate supplies a reliable valuation.

Think through the transfer

A proposed division should account for liquidity, taxes, loan obligations and the paperwork necessary to implement it. Retirement interests may require specialized orders or plan approval. A settlement that assigns an asset without addressing the related debt or transfer mechanics can leave serious problems unresolved.

A spouse proposes keeping a retirement account while the other keeps cash of the same face value. The assets may differ in tax treatment, liquidity and withdrawal restrictions. Compare their characteristics before treating the amounts as interchangeable.
