Civil Mediation: Prepare a Decision, Not Just an Opening Position

A mediation can be a structured opportunity to resolve a dispute. Preparation should address evidence, authority, workable terms and the alternative if no agreement is reached.

Evaluate strengths and weaknesses

Review the key documents, disputed facts, legal issues and potential remedies with counsel. Identify what remains uncertain and the cost of learning more through litigation. A persuasive position should be supported, but the private decision analysis must also be candid.

Know who can approve the deal

Determine which parties, insurers, lenders or organizational decision makers need to participate or approve terms. A negotiator without sufficient authority may be unable to complete a useful agreement. Follow the applicable mediation rules and attendance requirements.

Plan the terms beyond money

Timing, payment security, releases, property return, confidentiality and dismissal can matter as much as the headline amount. If agreement is reached, document it through the proper process. If not, clarify upcoming litigation obligations; mediation does not erase them.
