Shared Driveways and Easements: Read the Scope of the Right

Access rights depend on their source and terms. Longstanding use may raise questions, but it does not eliminate the need to examine the legal record.

Find the governing documents

Look for recorded easements, plats, deeds and maintenance agreements. Identify the properties benefited and burdened, the location and the permitted use. A right of access may not include every proposed use or improvement.

Separate access from maintenance

An agreement may address repair costs, snow or debris removal, drainage and damage. If it does not, legal analysis may be needed. Keep invoices and communications rather than assuming that paying once establishes all future responsibilities.

Evaluate a proposed change

Gates, widening, new construction or commercial use can create disputes about scope. Discuss the documents and facts before blocking access or making permanent alterations. A negotiated written arrangement may be possible, but the required parties and recording issues should be considered.
