Settlement Agreements: Resolve the Dispute and the Follow-Through
A settlement is only as workable as its terms and implementation. Address the exchange of payment, releases and case dismissal with care.
Define the complete resolution
Identify which claims and parties are covered and which matters remain outside the agreement. Broad release language may have consequences beyond the immediate dispute. Confirm authority to settle and whether any additional approval is required.
Coordinate performance
Specify payment amount, timing, method and conditions. If installments are involved, discuss default, cure and enforcement. A dismissal or release may need to occur at a particular stage rather than before the promised performance is secured.
Close the loop
Keep proof of payment, executed documents and filed dismissals or orders. Address confidentiality, property return, liens and future cooperation where relevant. Oral agreement on a dollar figure may leave important legal and practical issues unresolved.
